Chair Rental Terms & Conditions
Description: These Terms & Conditions outline the chair rental arrangement between salon owners and freelance professionals facilitated by MuseAvenue. This document is governed by the laws of the Australian state or territory where the transaction occurs.
1. Key Terms
1.1 Bond Requirement
1.1.1 A two-week bond is required prior to the commencement of the rental term.
1.1.2 The bond is held as security for compliance with these Terms & Conditions and may be used to cover unpaid fees or damages, subject to applicable laws.
1.2 Notice for Termination
1.2.1 Either party may terminate the rental arrangement with a two-week written notice.
1.2.2 Notice must be given in writing and delivered through a mutually agreed method, such as email or registered post.
1.3 Rent Payment
1.3.1 Rental payments are due on a weekly basis.
1.3.2 Payments must be processed through MuseAvenue’s secure Stripe payment system, ensuring a safe and reliable transaction process for both parties.
1.3.3 MuseAvenue does not hold responsibility for missed or delayed payments due to payment processor issues but will assist with any technical issues encountered in the payment process.
1.4 Included Facilities and Services
1.4.1 Basin products, gowns, and towels are provided and included as part of the rental package.
1.4.2 The freelance professional is responsible for using these facilities in accordance with salon policies and in a manner that maintains hygiene and quality standards.
1.5 Rental Details Access
1.5.1 The frequency and specific days of chair usage are detailed in the rental summary, accessible at all times via the MuseAvenue dashboard.
1.5.2 The amount of rent, agreed upon by both parties, is also documented in the rental summary and available in the MuseAvenue dashboard.
1.5.3 The start date of the rental term is determined in the rental summary and accessible from the MuseAvenue dashboard.
2. General Provisions
2.1 Role of MuseAvenue
2.1.1 MuseAvenue acts solely as an intermediary platform to facilitate the rental transaction between the salon owner and freelance professional.
2.1.2 MuseAvenue is not a party to the rental agreement and holds no responsibility or liability for the actions, omissions, or obligations of either party.
2.1.3 This arrangement does not constitute an employment, agency, partnership, or joint venture relationship between MuseAvenue, the salon owner, or the freelance professional.
2.2 Independent Business Relationship
2.2.1 This rental arrangement establishes an independent business relationship between the salon owner and the freelance professional.
2.2.2 Both parties retain full control over their own business activities, clients, pricing, and schedules within the framework of this agreement, in accordance with the relevant laws of the state or territory where the transaction occurs.
2.2.3 The freelance professional is responsible for complying with all legal and regulatory requirements relevant to their independent business operations, including tax obligations, insurance, and professional conduct.
2.3 Insurance and Liability
2.3.1 Each party is individually responsible for obtaining and maintaining appropriate insurance coverage for their respective business activities.
2.3.2 MuseAvenue assumes no liability for any loss, damage, or injury to property or persons resulting from activities undertaken as part of this rental arrangement.
2.4 Professional Conduct and Compliance
2.4.1 Both parties agree to maintain a high standard of professionalism, hygiene, safety, and customer care within the salon premises.
2.4.2 Freelance professionals must adhere to salon policies and industry standards, and both parties are required to comply with all applicable health and safety regulations as mandated by Australian law.
2.4.3 Any conduct deemed harmful, unsafe, or illegal may result in immediate termination of this rental agreement, subject to applicable notice and legal requirements.
2.5 Client Confidentiality and Data Privacy
2.5.1 Both parties commit to safeguarding client confidentiality and data privacy in accordance with Australian privacy laws.
2.5.2 Personal information and client records should be handled with discretion and used solely for the purpose of providing services within the salon.
2.5.3 MuseAvenue may collect data as necessary to facilitate the rental transaction but adheres to strict privacy policies to protect user information.
2.6 Governing Law and Jurisdiction
2.6.1 This document is governed by and construed in accordance with the laws of the Australian state or territory where the salon is located.
2.6.2 Both parties agree that any disputes arising out of or related to this agreement will be resolved exclusively in the courts of the relevant state or territory.
